(Reuters) – Tesla Inc. has filed an appeal against a US national labor relations commission that ruled that the electric carmaker had violated US labor law and ordered the agency to remove CEO Elon Musk from a tweet.

The electric car maker filed a petition on Friday in the US Court of Appeal in New Orleans to review the decision and the NLRB order issued on March 25.

In the petition, Tesla asked the court to review the order and grant Tesla “any additional exemption that the Court considers fair and equitable.”

Last month, the NRLB ordered Tesla to instruct Musk to delete the tweet and post a notification addressing the illegal tweet to all its facilities nationwide and to include language that says “We will take action.” to ensure that Musk complies with our directive. “

In his 2018 tweet, Musk wrote: “Nothing would stop the Tesla team at our car factory from voting. They could do that, if they wanted to. But why pay union dues and give up stock options for nothing? Our safety record is twice as good as when the factory was in the UAW and everyone was already receiving medical care. ”

NLRB also instructed Tesla to offer the reinstatement of a former employee, as well as to repeal the 2017 rules prohibiting the distribution of union literature in its parking lot regarding non-working time and the rules prohibiting the distribution of stickers, leaflets and brochures of unions without first obtaining permission.
