Justice does not recommend FEI against Eduardo Bathia

The appointed Secretary of Justice, Domingo Emanuelli Hernández, together with the director of the Division of Public Integrity and Affairs with the Comptroller, Wanda Casiano Sosa, issued a communication sent to the Bureau regarding the case against former senator Eduardo Bathia Gautier.

Emanuelli Hernández indicated that a communication was sent to the members of the committee this morning in which the appointment of an independent special prosecutor (EIF) for Bathia Gautier is not recommended, detailed in case number 2020-31- 102- 00043 Today, a communication was also sent notifying the party, the plaintiff and the defendant.

The complaint was lodged on 28 July 2020 in the Department of Justice by the Honorable José “Quiquito” Meléndez, representing the House of Representatives. The complaint alleges that lawyer Bathia Gautier holds bonds with the Electric Power Authority (PREPA) and the Pressuring Interest Fund Corporation, known by its acronym COFINA, and that, despite this, while holding the office of President of the Senate, he suffered illicit enrichment. and undue influence in the promotion and approval of Law 72-2015.

The complainant added that that legislation increased, inter alia, the sales and use tax, thus strengthening the COFINA safes. This situation, in his view, entailed a capital advantage for lawyer Bathia Gautier as the bondholder of that corporation.

The preliminary investigation carried out by the staff of the Comptroller’s Public Integrity and Business Division showed that there were no elements of the crime to justify the appointment of an EIF.
