They will demand reconsideration in the case of killing a woman in Gurabo

The Caguas Prosecutor’s Office will today request a reconsideration of the determination of no cause of arrest Dennis Rivera Aponte, suspected of killing his partner Ileana Rodríguez Félix in Gurabo, while managing to set a date for the indictment hearing.

At the same time, the Public Ministry and the Police are preparing to present “new evidence,” said Ricardo de Jesús, director of the Caguas Criminal Investigation Corps (CIC).

The movements appear after The judge Evyanne M. Mártir Hernández established that there is no reason for the arrest of Dennis Rivera Aponte, the husband of Rodríguez Félix, on charges of murder and use of a knife, although he found a reason for the accusation of lying to the authorities because he said that the 35-year-old woman died in a vehicle accident.

“I was in conversation with the interim prosecutor (from Caguas) Maribel Mojica and he informed me that today the reconsideration will be submitted in writing. They will also work with the date for rule 6 in altitude, “De Jesús told El Nuevo Día.

The term “rule 6” refers to the process of filing complaints in court. When the magistrate finds no reason to arrest a defendant, the authorities have a second chance to file charges in what is known as a “hearing”, which is assigned to a judge other than the one who saw the first appeal.

De Jesús pointed out that “the three prosecutors in the case, the police investigators and the staff of the Institute of Forensic Sciences have already established that they have sufficient evidence to present the case in accordance with rule 6.”

“Judges have a wide discretion to make a decision. In this case, unfortunately, no cause was found in these two offenses, although it was found in the provision of false information. We respect it, but we do not agree “, said the officer.

“What remains is to get the new date for the hearing to present the evidence again and to present some new evidence,” he added.

Although he was not emphatic about what this new evidence will consist of, he did not rule out that it could consist of “an analysis that has been pending from forensics. We continue to work on other issues, such as interviews and see if other images can be obtained, among others ”.

However, the head of CIC Caguas stressed that yesterday they presented enough evidence to link Rivera Pérez to the murder, including “the ICF pathologist’s report of the cause of death, which was a blunt crime, that the blows were not compatible with an accident by car ”.

According to the investigation, the man was the one who asked for help after he crashed into the car. When the units arrived, they found the lifeless woman in the passenger seat of a Mitsubishi Endeavor vehicle.

However, according to the police report, the woman had “blows to the head that are not compatible with a car accident”.

On the spot, they read the warnings of the law to Rivera Aponte, who from that moment used his right to remain silent in order not to commit self-crime.

The judge set a $ 20,000 bail that the defendant paid for lying to authorities about the cause of his wife’s death, although the charge of murder did not pass.

“We understand that with the evidence presented, the case should have been found at this stage of the trial,” said De Jesús, who said he could not provide details of the evidence presented yesterday so as not to affect the indictment.
