If a California district court judge agrees to the request, it will be the fourth time Holmes’ fraud case has been postponed.
Theranos Inc. founder Elizabeth Holmes is pregnant, lawyers and the government said in a court case requesting a six-week delay for her fraud trial, which was set to begin on July 13.
“On March 2, 2021, the defendant’s lawyer informed the government that the defendant is pregnant, with an expected due date in July 2021,” Holmes’ prosecutors and lawyers said in Friday’s case. “Given this evolution, it is not feasible to start the process on July 13, 2021, as currently scheduled.”
The two sides demanded that the trial begin on August 31.
If U.S. District Judge Edward Davila of San Jose, Calif., Agrees to the request, it will be the fourth time Holmes’ trial has been postponed. It was originally scheduled to start in July 2020 and then moved in October before being reset again for March – both delays due to the pandemic. Davila has repeatedly insisted on starting the process, hoping that conditions will improve enough with the vaccination of the population again.
Meanwhile, Holmes and prosecutors are struggling over what evidence the jurors will come to see and hear. Davila’s decisions will form the evidence, as well as the two parties’ strategies regarding the arguments that the lawyers will emphasize or be forced to defend.
The case is U.S. v. Holmes, 18-cr-00258, U.S. District Court, Northern California District (San Jose).
