The judges of the first collegiate court in the national district left out of the Odebrecht trial a communication sent then to the Attorney General of the Republic, Jean Alain Rodríguez, containing the plea agreement and the leniency agreement between the Brazilian public minister, Office of the Prosecutor General of Switzerland.
The unanimous court, presided over by Giselle Méndez and composed of Tania Yunes and Jissel Naranjo, ruled, Having accepted in part a motion by the defense of Andrés Bautista and Conrado Pittaluga, To which was added the other technical defense of the accused, requesting the exclusion of the mentioned evidence that the Public Ministry had to prove their accusation of bribery.
The court claimed to exclude evidence that the documents constituting evidence 1; 1.1; and 1.2 from the Public Prosecutor’s Office, have not been properly translated from Portuguese into Spanish by a court interpreter, as required by law.
However, judges will allow the Public Ministry to incorporate evidence 1.3 into the debate; 1.4; 1.5 and 1.6, to determine whether the court appreciates Marcos Vasconcelos Cruz’s award-winning statements and other collaborations.
Also, the court adjourned the hearing of the trial for tomorrow, Tuesday, at 9:00 in the morning, to continue with the presentation of documentary evidence by the accusing entity.
While the defense of the accused Ángel Rondón, led by José Miguel Minier, considered that what happened in court is a sign that the Public Ministry has no evidence in this case.
The Special Prosecutor for the Persecution of Administrative Corruption (PEPCA) advised the incumbent Wilson camacho and the accompanying team of prosecutors to drop the charge to “avoid a manifestation of bad taste for society.”
For his part, Camacho announced that they will not remain in his arms and will file an opposition appeal for the judges to reconsider their decision.
These documents will show that through the leniency agreement between the Brazilian Public Minister, the United States Department of Justice and the Swiss Attorney General’s Office, the name of Constructora Norberto Odebrecht, admitted that in that period between 2001 and 2014, payments in different countries, including the Dominican Republic, through intermediaries and government officials, to facilitate or ensure the award of certain contracts for the construction of infrastructure works.
It will also prove that, under these agreements, the list of statements (denunciations) of Odebrecht employees describing the individual participation of each of the employees in this process, in the sponsored bribe scheme, was sent to the Dominican Public Ministry by the construction company.
The evidence is a communication sent to Jean Alain by the Brazilian Federal Public Ministry, which contains the US-DOJ plea agreement, the Brazilian leniency agreement, statements of the following collaborators: employee 1 and Marcos Vansconcelos Cruz, with their confirmation data.
