Nintendo is dealing with another Joy-Con class action lawsuit

It lasted almost three years, but my two original Joy-Con sets started to fall apart: it’s time to throw them in the pasture. It seems that the fact that the controllers took so long to malfunction is an abnormal aspect, because Nintendo has been hit by several lawsuits in recent years; some of which started in earnest shortly after launch.

Now we can add another to that stack. Filed on January 15 this year, the Canadian law firm Lambert Avocat Inc. calls now for this class action to be brought before a superior court in Quebec.

Here is the main argument presented by the company:

“In November 2017, our client bought a Nintendo Switch gaming system. After 11 months of use, he noticed that the left Joy-Con ™ controller was defective. Her character moved in a direction without her input, a problem known as Joy-Con Drift. Then he noticed that the problem persists in other games as well as navigating the main menu.

Our customer then contacted Nintendo and sent the left controller to the Nintendo factory for repair. However, two months after receiving it, she noticed the same problem with the right controller, then with the second pair of Joy-Con controllers she bought, as well as with the Nintendo Switch Pro controller.

Our client finds that this defect seriously compromises the basic function of the controllers and prevents it from using the gaming system correctly. “

The company cites the Consumer Protection Act in their submission, stating that ‘the goods purchased must be suitable for the purposes for which such goods are normally used and must be durable in normal use for a reasonable period of time, taking into account the price and conditions of their use. “

If you remember, Nintendo has been asked about the situation several times by journalists, fans and even investors: and generally declined to comment, in part because of the ongoing nature of lawsuits like this. It seems that time has passed for Nintendo: it will probably have to answer seriously at the corporate level, sometime this year, beyond the current repair site.
