Magistrate Miriam Germán Brito seized the lawyer of the Court of Appeal in the province of Santiago, of an investigation against the examiner Mauricio Francisco Osoria Castillo, accused of seriously harming a minor.
Germán Brito took action at the request of Magistrate Juan Medina de los Santos, Inspector General of the Public Ministry, who initiated an disciplinary investigation ex officio against Inspector Osoria Castillo.
At the hearing of Víctor González, a lawyer for the Santiago Court of Appeal, Judge Germán Brito explained that the above-mentioned case presented evidence typified by various articles of the Dominican Penal Code and Law 136-03, which creates the Code for the Protection of Fundamental Rights. of girls, boys and teenagers.
The investigation of the case came from the fact that the victim, whose identity is preserved in order to maintain his integrity, filed a complaint on 28 December 2020 in a maintenance application against Inspector Osoria Castillo, by virtue of the fact that he participated in a 23 weeks pregnant.
The information allowed Inspector Medina de los Santos to establish that, although the young woman reached the age of majority on 19 December 2020, the pregnancy took place at the age of 17.
The young woman had also been to the Gender Violence Unit, because she feared for her life and to report threats from the inspector, and even from his wife, Alexandra Cabrera.
The forensic psychologist who treated her determined that the young woman “could be at risk of serious injury and / or death” and recommended that she be sent to a foster home.
Medina de los Santos regretted that some users of social networks contribute, probably without malicious intent, to increasing the vulnerability of victims who go to gender-based violence units and that in some cases they need to be protected by prosecutors and the Ministry of Women. and when those affected show resistance to receiving support.
