Recently, the FDA supported the approval of COVID-19 Pfizer and Moderna vaccines. Now, the U.S. Equal Employment Opportunity Commission has updated guidelines on pandemic procedures, noting that companies now have the right to ask employees to receive a COVID-19 vaccine when it is available to them.
The EEOC issued a statement last Wednesday regarding the update of the procedure, saying: “ADA [Americans with Disabilities Act] allows an employer to have a qualification standard that includes “a requirement that a person not pose a direct threat to the health or safety of persons at work”. “
Currently, the ADA limits employers who have the ability to request a medical examination. However, the guidance notes now say that vaccination does not count as a medical examination. This means that the vaccination requirement would not be a violation of the ADA. Stay tuned for more details.
