Guevara defends the voting method applied in the TC

The President of the Constitutional Court, Milton Ray Guevara, defended yesterday the voting system applied by that high court for the approval of a sentence, which requires the vote of at least nine of the 13 judges.

This method was the reason for delaying the hearing of some cases of unconstitutionality, as mentioned in a paper published this week by Listín Diario.

The President of the TC, however, considered that this voting mechanism encourages the search for consensus, the quality of decisions and strengthens legal certainty.

“The complexity and nature of the topics discussed favors broad debates that continue until a consensus can be reached. Last year alone, 133 sessions of the Plenum of Magistrates took place, of which 107 took place during the pandemic (Covid 19), ie practically “, he underlined.

He recalled that the Constitution itself provided for TC decisions to be taken by a qualified majority of 9 votes or more from its judges, so this implies that at least that number of magistrates must agree to issue a decision.

“The rules of quorum and majority established by the constituent are strictly observed,” he said in a speech of responsibility for the ninth anniversary of the TC. Guevara supported the approval of a referendum law and called on all institutions and officials to comply with constitutional rulings without undue delay.
