Alianza Lima and TAS: everything you need to know about Wednesday’s resolution NCZD | FOOTBALL-PERU

Decisive days. The story between Lima Alliance and TAS It will end on Wednesday, the 17th, when the blue-and-whites know the decision that will leave them or not in League 1. The Court of Arbitration for Sport is the highest body of justice in this area of the world, so the decision will be final. The request is addressed to the Peruvian Football Federation (FPF), where Licensing Commission, and Carlos Stein, as affected.

THE LAST MINUTE

After five long hours of hearings in which the Peruvian Football Federation (FPF) and Lima Alliance presented their arguments, the Court of Arbitration for Sports will issue tomorrow, Wednesday, the resolution that could bring the intimate team back to League 1 after the relegation.

In this regard, the technician Carlos Bustos it was expected. “We are convinced that there can be a chance for League 1. Alianza Lima’s statement is correct and valid, it is a valid protest and it can come out in favor,” he said.

HOW IT ALL BEGUN

But how did it get there Lima Alliance to TAS? On November 28, the Victorian team relegated to League 2 after losing 2-0 to Sport Huancayo at Nacional. They immediately expressed their discomfort because, a few days before, the Licensing Commission had barely fined Carlos Stein. with a fine and not the loss of debt points. Alianza believes that because they are repetitive, the punishment should be higher. That the Nordics lose a single unit, they kept them in first place.

This request was rejected and its directors appealed to the Licensing Court. As they did not have a direct punishment, they asked Alianza Lima to “prove their role as intervener”. Unable to do so, his application was rejected on 29 January. There are no more entities to turn to in Peru, Thursday, February 4th. For this, he made a payment of one thousand Swiss francs ($ 1,075).

THE TRIAL

TAS He was competent in this case, starting the process. In La Victoria they asked her FPF and Carlos Stein to accept an accelerated trial, which reduced the number of waiting days, which they surprisingly accepted on February 17th. On the 24th, Alianza Lima presented its reports (documents, letters, resolutions, etc. that support its claim), but only on March 11 did the deadline for the defendants expire.

Command Lima Alliance, not having a direct punishment against him, is the correct application of the regulations of League 1 2020, as well as of the Licenses. This request will be the only thing that TAS will solve in this case. Moreover, based on the background, the options for the decision are multiple: you can agree with Alianza 100% and you can return it to First, as well as in a partial way, which could leave it in League 1, both as long as it remains in the criteria.of FPF or rejects the application. So far, it would be impossible to predict a decision.

The hearing is scheduled for Monday, March 15. Three arbitrators, each of the parties elected one, with the one selected by CAS at the head, are responsible for the future of the case. Spanish became the official language of the Court last year, which will be very helpful in this situation. Via Zoom, each party will make its arguments known.

WHAT DOES THE ALLIANCE NEED?

Lima Alliance it must show that the regulation has been misapplied. In addition to the explanation of each of the legal terms, in this case Peruvian (such as what is a CTS, RUC, etc.), obviously unknown to CAS arbitrators. The other party has the responsibility to argue that everything was done in order. Witnesses can be used.

This hearing, which can last several hours, will simultaneously have Carlos Stein’s debut in League 1 2021. This could generate a headache for FPF in case of failure. TAS, which should be known on Wednesday, March 17, is not so clear about a possible return of Alianza Lima. As mentioned above, there are several options for the decision and whatever it is, it must be followed up to the letter and not as interpreted by both parties.
