The national district prosecutor has been seized of a subpoena against the presidents of the Dominican Bar Association (CARD), Cap Cana Group and Bávaro International Airport, accusing him of alleged fraud against the state to simulate transactions in excess of 2 billion pesos without paying taxes.

The complaint was filed with Chief Prosecutor Rosalba Ramos, against Miguel Alberto Surún Hernández, Abraham Hazoury Toral, Rafael Fernández de Castro, from Bávaro International Airport and the Cap Cana Group.

The money laundering and criminal association filing was filed by American businessman Mariano González Díez and his company Maho Trading through lawyer Jorge Lora Castillo.

In court, the prosecution is asked to investigate the proposals in the complaint, in addition to requesting pre-trial detention because of the seriousness of the allegations and the crimes reported.

According to the lawyer, the transfer is intended to eventually compensate Puerto Rican doctor González Díez, a buyer of land in Cap Cana, for about $ 2,970,000 in 2007. The payment had to go to an escrow account and funds used in the infrastructure. of works of Trump’s Los Farallones project, which did not happen.

The complaint alleges that due to misuse of these resources and non-compliance, the investor went to the Center for Alternative Dispute Resolution in the Chamber of Commerce and Production of Santo Domingo and Cap Cana sentenced to pay $ 2,970,000 and damages. worth $ 567,636 in December last year.

According to the complaint, Surún Hernández set up CVC ONE, Inc. in Panama with a minimum capital on November 11, 2009, registered it on May 21, 2012 in the Chamber of Commerce and Production of La Romana and later used it in collaboration with Hazoury Toral to buy the land on which he would have built the International Airport Bávaro for a total of 116,455,653.59 US dollars, between June and July 2019.

The president of the Bar Association (CARD), whose wealth declaration does not include the foreign company, assigned the property to Hazoury Toral on July 8, 2019, but the transfer of shares was registered on August 27, 2019. 2020 CARD receives public funds and its president is obliged to he declares all his property under oath.

As indicated in the complaint, the land was sold to Bávaro AIB SAS International Airport on October 21, 2019 for USD 38,490,938, the equivalent of USD 2,232,474,000, given that Hazoury Toral was also president of both commercial grounds. He sold and bought himself, but in just three months he re-evaluated 19 times what CVC ONE initially paid to the original landowners.

“It goes without saying that CVC ONE Inc., by itself, did not have any legitimate, recognized or registered economic activity that would allow it to make these one million dollar investments, based on money laundering, evasion tax, as a previous crime and, especially, through the obvious use of the will ”, is indicated in the complaint.

In these financial maneuvers, the lawyer Lora Castillo observes an association of criminals for the embezzlement of the Dominican state under concealment and patrimonial simulation. Given its understanding and the low capitalization of the Panamanian company and its exclusion from Surún Hernández’s affidavit, it is necessary to determine the origin of the resources used to purchase the land on which the Bávaro International Airport is said to have been built.

The alleged acquisitions were made in principle by Rafael Fernández de Castro, who entered the stage of CVC ONE, Inc., owned by Surún Hernández, on May 5, 2019, when the board of directors granted him the power for “the day-to-day and current administration of the entity and buys, buys, exchanges and sells real estate ”.
