Jensen Medina Cardona, charged with the murder of Arellys Mercado Ríos at a marina in Fajardo, returned to the court of first instance of the said municipality today, Thursday, for an argumentative hearing before the trial against him continued.
Medina Cardona first appeared under electronic surveillance after being released after posting a $ 300,000 bond last December. Exactly $ 300,000 was the defendant’s initial bail, but it was later increased to $ 1,150,000.

The defendant, who arrived on the road, was dressed in formal clothes and looked relaxed during the argumentative hearing. He was accompanied by his mother and father.
Medina Cardona returned with lawyers Jorge Gordon Menéndez, Orlando Cameron Gordon and Jorge Gordon Pujols.
Meanwhile, the prosecution service was represented by prosecutors Eduardo Beale, Dianette Aymat and Jaime Perea. Fajardo district attorney Yamil Juarbe was also in the room.
On behalf of the victim, Arellys Mercado’s mother, Nitza Ríos, came to court. Upon arrival, he described how difficult it was to spend Christmas without his daughter and spoke of his hope that justice would be served.
“It was hard, this Christmas is the second Christmas that I don’t have her, it’s very hard not to have her hug, not to have her presence. But God has done other things, like giving me a grandson from another daughter I left behind who took stock, ”he said.
“I continue to trust Pope God, he is the one who gives me strength, the one who keeps me going, waiting for the justice to come,” Ríos added.
Today’s court proceedings were held for each of the parties to rule on the controversy for recovering Medina Cardona through jury trial rather than trial by a court as he had already chosen.
“While it is true that he waived a jury trial, we were left with a decision that stayed under the previous bases (from a jury trial that did not have to be unanimous)”Gordon Menendez countered.
However, the attorney added that during the trial parade and subsequent suspension due to the pandemic, the United States Supreme Court ruled that all jury trials in criminal cases must resolve disputes unanimously. He used that argument as a reason to request a trial in this modality.
“The sign has been cleared (with that event),” said the lawyer.
Prosecutor Eduardo Beale, for his part, emphasized during his speech that the Court of Appeal rejected all legal arguments of the defense, asking for a refund of a jury trial.
“These are the same arguments that you get today,” said the prosecutor at the judge.
“He (Medina Cardona) cannot decide whether or not to waive a right, because he has already resigned under the law and it was valid”Beale added.
Leaving the court, prosecutor Yamil Juarbe said he was hopeful that the defense’s arguments “do not affect the discretion of the court,” as they are statements that have already been rejected by the Court of Appeal.
In addition, he assured that the evidence they are keeping, as well as the version of more than 20 witnesses, are not prescribed and are ready to resume trial.
“The prosecution is prepared and eager to start and complete the trial,” Juarbe said.
Judge Gema González, who is also leading the trial, presided over today’s proceedings and stated that her decision will be provided in writing shortly. The court has scheduled a status hearing for February 11 at 10 a.m. in the same court.
The Prosecution assured them that they would request the assistance of the Attorney General, the Chief Prosecutor and the Secretary of Justice to appeal if the judge decides to restore Medina Cardona’s right to a jury trial.
Medina Cardona is charged with one first-degree murder and two cases of gun law violations.
