The execution, which was postponed on December 8, was moved by the court to January 12.
It concerns a single woman on death row and for the first time in more than 60 years the United States will execute a prisoner.
The facts
According to the file, Montgomery strangled pregnant Bobbie Jo Stinnett in 2004 to cut open her belly with a knife and kidnap her baby.
In December 2004, as part of a premeditated kidnapping and murder plot, Montgomery drove from his Kansas home to Stinnett’s Missouri home, reportedly to buy a puppy.

Once inside the residence, Montgomery attacked and strangled Stinnett, who was eight months pregnant, until the victim lost consciousness. Montgomery then sliced Stinnett’s belly with a kitchen knife, regaining consciousness.
A fight ensued and Montgomery strangled Stinnett to death. Montgomery then removed the baby from Stinnett’s body, took the baby and tried to pass it on as her own. Montgomery later confessed to killing Stinnett and kidnapping his son.
